Customers are solely responsible for reviewing the privacy policies and terms of use of any third-party services they access through links, advertisements, or integrations provided by Næxon.

 

Næxon expressly disclaims responsibility or liability for the privacy, security, content, practices, policies, or actions of any unaffiliated third parties, including but not limited to Amazon, eBay, Meta, Google, payment processors, shipping carriers, and marketing platforms.

2. INFORMATION WE COLLECT

Næxon may collect, store, process, and use various categories of information as permitted by applicable law, including but not limited to:

Personal Information: Names, billing addresses, shipping addresses, email addresses, telephone numbers, company names, employer information, account credentials, order histories, customer service records, and other information voluntarily provided by users.

Commercial Information: Purchase history, transaction details, product preferences, warranty requests, returns, exchanges, customer inquiries, and marketplace interactions.

Technical Information: IP addresses, browser types, operating systems, device identifiers, geolocation information, language preferences, referral sources, website usage patterns, and diagnostic information.

Marketing Information: Subscription preferences, email engagement data, SMS interactions, promotional participation, survey responses, feedback submissions, and advertising interests.

5. EMAIL MARKETING

By providing an email address, customers expressly consent to receive newsletters, product announcements, promotional offers, educational content, surveys, and other marketing communications from Næxon and its authorized service providers.

Users may withdraw marketing consent at any time through available unsubscribe mechanisms; however, such withdrawal does not affect transactional or legally required communications, including but not limited to:

  • Order confirmations;
  • Shipping notifications;
  • Account updates;
  • Security alerts;
  • Warranty information;
  • Product recalls;
  • Policy changes.

Næxon makes no guarantees regarding delivery, receipt, or uninterrupted availability of electronic communications and shall not be liable for delays caused by third-party email providers or technical failures.

6. SMS COMMUNICATIONS

Customers who voluntarily enroll in SMS programs expressly consent to receive recurring text messages regarding promotions, order updates, customer service communications, account notifications, and other business-related information.

Message frequency may vary. Standard carrier messaging and data charges may apply. Participation in SMS programs is entirely voluntary and is not a condition for purchasing products or receiving services.

 

Users may revoke consent at any time by following opt-out instructions. Næxon is not responsible for delayed, failed, or undelivered messages resulting from wireless carrier issues, device limitations, technical interruptions, or factors beyond the Company’s reasonable control.

7. COOKIES AND TRACKING TECHNOLOGIES

Næxon uses cookies, web beacons, pixels, scripts, tags, and similar technologies to:

9. PAYMENT INFORMATION

All payment transactions are processed through independent third-party payment providers and marketplace systems. Næxon does not store complete credit card numbers, banking credentials, security codes, or other sensitive payment information on Company-operated systems.

 

Customers acknowledge that payment processors maintain their own privacy, security, fraud-prevention, and compliance obligations. Næxon shall not be liable for acts, omissions, breaches, interruptions, or failures attributable to independent payment service providers.

10. INFORMATION SHARING

Næxon does not sell personal information for monetary consideration. However, information may be disclosed to trusted service providers, contractors, affiliates, business partners, logistics companies, payment processors, marketing vendors, fraud-prevention entities, legal advisors, insurers, and governmental authorities when reasonably necessary.

Information may be shared to:

  • Protect Company assets;
  • Defend legal claims;

11. BUSINESS TRANSFERS

Customer information may constitute a business asset and may be transferred, assigned, licensed, sold, or otherwise conveyed in connection with mergers, acquisitions, restructurings, financing transactions, reorganizations, asset sales, bankruptcy proceedings, or other corporate events.

 

Users expressly acknowledge and consent to such transfers, subject to applicable legal requirements, and agree that successor entities may continue utilizing such information in accordance with this Policy or its lawful successors.

12. DATA SECURITY

Næxon employs commercially reasonable administrative, technical, organizational, and physical safeguards intended to protect personal information from unauthorized access, alteration, disclosure, misuse, or destruction.

Despite these efforts, no system, network, software platform, communication channel, or storage method can guarantee absolute security. Users understand, acknowledge, and voluntarily assume the inherent risks associated with electronic communications and online transactions.

 

To the maximum extent permitted by law, Næxon disclaims liability for cybersecurity incidents, unauthorized access, data breaches, service interruptions, malicious attacks, or losses arising from circumstances beyond its reasonable control.

13. DATA RETENTION

Næxon retains information only for legitimate business purposes, including contractual performance, legal compliance, accounting obligations, warranty administration, dispute resolution, fraud prevention, and protection of Company rights.

Retention periods may vary according to operational requirements, applicable laws, regulatory obligations, litigation holds, tax requirements, and other lawful considerations. Following expiration of applicable retention periods, information may be deleted, anonymized, aggregated, or otherwise rendered non-identifiable at Næxon’s sole discretion.

14. CHILDREN'S PRIVACY

Næxon products and services are intended exclusively for adults and individuals legally capable of entering binding agreements. We do not knowingly solicit, collect, process, or maintain information from children under thirteen (13) years of age.

 

Parents or guardians who believe a child has provided personal information should contact the Company immediately. Upon verification, Næxon will take commercially reasonable steps to remove such information consistent with applicable laws and operational requirements.

15. CUSTOMER RIGHTS

Subject to applicable laws and verification requirements, customers may request access to, correction of, deletion of, or restrictions concerning their personal information. Requests should be directed to cs@naexon.com and must include sufficient information to verify identity and ownership of the requested records.

 

Næxon reserves the right to deny, delay, limit, or refuse requests where permitted by law, including circumstances involving fraud prevention, contractual obligations, legal compliance, protection of intellectual property, security concerns, or preservation of legitimate business interests.

16. DO-NOT-TRACK SIGNALS

Because no universally accepted industry standard currently governs browser-based “Do-Not-Track” mechanisms, Næxon systems may not recognize, interpret, or respond to such signals. Users should independently manage privacy preferences through browser settings, advertising controls, device configurations, and third-party opt-out tools where available.

17. INTERNATIONAL USERS

Users accessing Næxon services from outside the United States acknowledge and expressly consent to the transfer, storage, processing, and handling of their information within the United States or other jurisdictions where Næxon or its service providers operate.

 

Such jurisdictions may maintain privacy protections different from those in the user’s country of residence. By using our services, international customers voluntarily assume these risks and consent to applicable cross-border data transfers.

18. THIRD-PARTY WEBSITES

Næxon websites may contain links to external websites, online marketplaces, advertisers, social media platforms, or service providers.

These external services operate independently and maintain their own privacy policies, security procedures, and terms of use. Næxon neither controls nor endorses the privacy practices of third parties and assumes no responsibility or liability for their content, activities, data collection practices, or security measures. Access to third-party websites occurs entirely at the user’s own risk.

20. LEGAL COMPLIANCE

Næxon may disclose information whenever reasonably necessary to comply with applicable laws, governmental requests, subpoenas, court orders, investigations, regulatory requirements, or law-enforcement activities. The Company additionally reserves the right to disclose information to:

  • Prevent fraud;
  • Investigate unlawful conduct;
  • Enforce contracts;
  • Protect customers;
  • Safeguard employees;
  • Defend intellectual property;
  • Preserve business operations;
  • Protect public safety.

Such disclosures may occur without prior notice when permitted or required by law.

20. INDEMNIFICATION

To the fullest extent permitted by law, customers agree to defend, indemnify, and hold harmless Næxon, its owners, officers, directors, employees, affiliates, successors, agents, contractors, suppliers, and representatives from and against any claims, demands, liabilities, damages, judgments, costs, losses, penalties, settlements, and attorneys’ fees arising from:

  • Violations of applicable laws;
  • Breaches of Company policies;
  • Product misuse;
  • Unauthorized modifications;
  • False information submissions;
  • Infringement of intellectual property rights;
  • Improper use of Company services;
  • User-generated content;
  • Negligent or intentional misconduct.

This obligation survives termination of customer relationships and continued use of Company services.

21. CHANGES TO THIS POLICY

Næxon reserves the absolute right, at its sole discretion, to amend, revise, supplement, replace, or update this Privacy Policy at any time without prior notice unless otherwise required by applicable law.

Revised versions become effective immediately upon publication. Continued use of Company websites, services, products, accounts, or communications following such updates constitutes acceptance of the modified Policy. Customers are solely responsible for periodically reviewing this Privacy Policy to remain informed of any changes.
